First complaints about the newly voted CovidCheck rules have reached labour unions, three organisations said on 12 November, supporting staff who opened legal proceedings with local courts.

From 1 November, employees have to show a QR code signifying a complete vaccination scheme, a negative PCR or certified antigen test result or a recovery from the virus, if their company choses to introduce CovidCheck. Refusal to comply dismissal. 

The CGFP, LCGB und OGBL unions----are now supporting the first complainants. Some non-compliant employees were refused entry to their office. This is particularly the case in the public sector, where “covid checks seem to be applied in an extremely rigid and inflexible manner,” the unions said in a joint statement. 

Those who have already sent a complaint to the emergency court and administrative court will receive the full support of the labour unions, they said.

Uncertain legislation around CovidCheck

The trade unions now also plan to look closer at the legislation around CovidCheck, citing personal data protection and individual citizen’s rights as arguments against the continued application of the procedure. 

Though CovidCheck won , other companies, such as , chose not to implement the procedure due to rebuttals from staff delegations. 

Accusing the government of brushing aside the unions’ before voting in the law, the OGBL demands “the immediate reintroduction of free rapid tests, which is almost imperative in view of the rapidly rising infection figures.” 

As Luxembourg goes through a fourth wave due to increasing infection rates, as chief medical officer Jean-Claude Schmit said , the unions said “the common goal must be to contain the pandemic.”
